A state appeals court panel Tuesday overturned two felony convictions against Jeffrey Hubbard, the former superintendent of the Newport-Mesa Unified School District, the Daily Pilot reported.
Hubbard was convicted in January 2012 of two felony counts of misappropriating public funds while he was superintendent of the Beverly Hills Unified School District. During Hubbard's trial, prosecutors said he illegally authorized a $20,000 stipend and $500 monthly car allowance to Karen Anne Christiansen, a former facilities director for Beverly Hills Unified.
In its ruling California's 2nd District Court of Appeal said according to state law, as superintendent Hubbard was not "charged with the receipt, safekeeping, transfer or disbursement of public moneys," the newspaper reported.
In February 2012 Hubbard was sentenced to 60 days in jail, and ended up serving four days before being released. He was also ordered to pay $23,500 in restitution to the school district as well as a $6,000 court fine and to complete 280 hours of community service and three years on probation.
Hubbard was fired from the N-MUSD one day after he was convicted.
