Plastic Surgeon Charged With Performing Unnecessary Procedures

The Orange County District Attorney's Office believes there could be more victims of plastic surgeon Jay W. Calvert.

Prosecutors are looking for people who may have been victimized by a Newport Beach plastic surgeon, who is accused of performing unnecessary procedures on a patient in order to fradulently overbill his insurance company, the Orange County district attorney's office reported Monday.
 
Jay W. Calvert, 45, of Newport Beach, was charged last week with one felony count each of medical insurance fraud, manufacturing documents to support the fraudulent bill and perjury under oath. Prosecutors said Calvert is a plastic surgeon who practices in Newport Beach and Beverly Hills.

The charges against Calvert stem from a 2009 incident when a man went into Calvert's Newport office for a rhinoplasty. Prosecutors allege Calvert performed additional unnecessary procedures on the man which caused long-term medical damage, although the man said he only wanted to have a rhinoplasty.

According to the D.A.'s office, Calvert performed the unnecessary and unwanted medical procedures and manufactured documents in order to overbill the patient's medical insurance company by more than $40,000.

In August 2010 during a civil lawsuit with the patient, Calvert is accused of committing perjury under oath.

If convicted Calvert faces a maximum of six years and eight months in state prison. Farrah Emami, D.A. spokeswoman, said Calvert is out of custody on his own recognizance, but will return to court on Dec. 13 for his arraignment.

"He turned himself in to the court on Nov. 14 after charges were filed against him," Emami said.
