Puppy Store Protesters File Countersuit Against Shop Owner

The motion seeks attorney fees from I Heart Puppies store in Corona del Mar for allegedly trying to illegally censor critics.

 

An anti-SLAPP motion has been filed on behalf of the West Coast director of the Companion Animal Protection Society against the owner of the I Heart Puppies store in Corona del Mar, court records show.

Dave Simon, an attorney for CAPS, said the motion was filed last week under California's anti-SLAPP statue, and has the effect of not only dismissing the lawsuit but also of providing a mandatory attorneys' fees award.

Called a strategic lawsuit against public participation, SLAPP is a lawsuit that is intended to censor, intimidate and silence critics by burdening them with the cost of a legal defense. The anti-SLAPP statute allows a person to counter a SLAPP suit filed against them.

"Under California law, you can't unlawfully deny people the ability to express themselves and that's what the store owner is attempting to do with her lawsuit," Simon said.

The motion was filed in response to a request for a restraining order that was filed July 22 by Brooke Bradford, the store's owner, and has since been dismissed, according to court records

"The judge did not agree with her position and he denied the restraining order," Simon said. 

Bradford did not return calls or emails seeking comment for this story.

CAPS, a nonprofit group, has been conducting an investigation into the store since July 5 following complaints from residents and assertions that the store gets its puppies from commercial Midwest puppy mills. Since then, I Heart Puppies was temporarily closed while it complied with safety regulations  and was the focus of a protest Sunday.

"My hope is that they will stop attempting to intimidate me and other dog lovers and that they will stop trying to silence us by abusing the court system," Davis said. "We weren’t breaking any laws and the court knows that and the court made it quite clear."

Ms. Bradford, the owner of "I Heart Puppies," is the one who started this by filing a restraining order. The court denied her, and her attempt to silence the truth and intimidate activists failed. She can still turn this around and become a shining light in Corona Del Mar instead of a stain.

The parents of these puppies live in small cages their whole lives, and all pet stores I have ever heard of purchase their puppies from Puppy Mills...PERIOD. That's what this is all about. Do the right thing for the dogs that are never seen (the puppies parents) and stop selling puppies, BECAUSE THEY DO COME FROM PUPPY MILLS. "Speaking for them because they cannot".

I managed a OC pet store for 4 years and not all pet stores get their dogs from puppy mills. I have been to I heart puppies and their animals look and seem signifcantly healthier then for instance Russo's in Newport Beach(GROSSEST PET STORE I HAVE SEEN IN OC). I would try to pick a better target.

What do you know about Russo's? My first job ever was at Russo's. The dogs are cleaned and fed and are checked by vets. You have no idea what you are talking about! Hell I spent thousands on a puppy from a top breeder and it had a inherited disease.....who can know? Can a parent know if their kid will get cancer? As they say...GIVE ME A "F___ing" BREAK, go get a life!

when it comes down to she said/she said.. the community needs to use common sense. who is most likely to charm you and lie to you: a compassionate volunteer with investigation & documentation behind them, or a store owner who chooses to need your dog buying thousands to pay their bills? this store knows that people are not stupid and they are using tactics like producing a single kitten up for adoption in their store today. they know that one humane act makes their business appear to be telling the truth. they also know that one kitten for"adoption" will in no way hinder their dog sales. the body pile up of dead shelter animals is 1/2 million YEARLY in CA. So, why are people still buying the puppies of freshly bred dogs????

Just because the dog seems healthy does not mean this it is or that it will not have problems down the line. I have a wonderful puppy mill survivor that is deaf and blind and suffers neurological damage as a result of over breeding. He looked and seemed healthy when he was purchased. But the minute he exhibiting signs of blindness, the owners dropped him at the shelter. Looks can be deceiving and the puppy mill operators are profit driven; sick or dead puppies are just the cost of doing business, like scrap at a manufacturing plant. All pet stores that are not selling rescues or shelter dogs need to be targeted because the perpetuate cruelty.

people, ask yourself... why would non profit groups and the HUMANE SOCIETY tell everyone to NOT buy animals from pet shops and online.... because you can so easily be lied to, showed false 'documents' if any and pictures from wherever in order to believe that the animal is comming from somewhere else. this shop just keeps saying that their breeders are USDA certified. what that means is that they are admitting that the breeder is a mill. CAPS and the U.S. department of agriculture have deemed AT LEAST one of their common breeders a mill with numerous violations. violations on a USDA certified mill !!! the certification has the BARE MINIMUM of standards and they cant even keep up with those. DISGUSTING and CRUEL.

Steve thinks cruelty to dogs is funny and cool. Why does he hate mans best friend? Perhaps he was bitten as a child. That's what happens when you hurt animals, they bite you in self defense or when they're fearful. It is my hope that in 10 years when Steve finally becomes a grown-up adult he will learn to like dogs and dogs will learn to like Steve.

Steve - All these protests are done by working first with the police. A mall is still in America, and therefore U.S. citizens' first amendment rights to free speech also apply to a mall, especially when protesters have cleared everything they plan to do with lawyers and city police. I hate to burst your bubble, but animal lovers have freedom of speech in America, too. Pet store freaks like you aren't the only ones with the protection of free speech (you mention on this board that you worked at Russo's - yuck!). Obviously you aren't very well-educated. I wouldn't expect you to be if you work in a pet store. Your ignorance about animals, the law, everything is just unbelievable. Actually, yes we can. Google Barkworks. It is unconstintutional to prevent assembly or free speech on private property that is open to the public (malls) in CA for the purposes of boycotting a store. Learn the law. We live a great country, where we can shine the spotlight on the truth. Puppy mills will be illegal soon. We are dog lovers. Millions of us.

I think those who support such shops as Russo's and I Heart Puppies should visit just one puppy mill.

Let me tell you about my dog, once a breeder in a puppy mill. After breeding her for years - she is, after all, a rare blonde - the dog had no apparent medical attention for gross infections of both ears which rendered her deaf and screaming in pain from it all. It was the screaming in pain that caused the breeders to dump her into the shelter where she was about to be put down. Thanks to an astute volunteer, a rescue group ready to intercede, and two veterinarians who performed 5 hour surgery on both ears [total ear canal ablation], this dog, FOR THE FIRST TIME IN HER LIFE, knows what a leash is and has a loving home. She had no socialization and no human comfort in all her years. She was a puppy machine, nothing more.

It's a monstrous society that allows breeding when there are so many purebreds - young ones, too - in the shelters.

Steve... Funny that you say we protest a business with no proof...Newport Beach City Council knows otherwise.. I am a native and a citizen of Newport Beach, and I just presented them the FACTS in the form of Legal government agency USDA reports... on camera, on record, in a city council meeeting... I personally read them multiple and repeated violations of the grotesque and diseseased breeding facilities I Heart Puppies uses, and the suffering of the severly neglected animals that recieve no verterinary care... So why dont you join us on the side of humaneness and integrity, doodle up a sign, and gp protest Russo's as you are very knowledgable of the condition of their puppymill puppies as well...You could spend your time saving lives, instead of talking out of places that making yourself look foolish...

It is important that EVERYONE do their research. It is not that difficult to educate oneself on how pet stores acquire their puppies! Until puppy mills are illegal, it is important to stop the legal sale of puppies that come from the mills! Puppy mills are horrific, and must be stopped. The exploitation of animals and children is inexcusable. FYI.. Steve... My family has advocated for the vulnerable, to include children and animals for decades. We have been fortunate to have touched many children so that they might grow up to be passionate, caring adults with minimal scars. You will find, that in this population, many will advocate for those who can be easily exploited. Not just animals! Wow! What do you stand for?
